Q. Our prevention of abuse policy refers to ‘No Secrets’. Do we need to update it?

A. The government’s ‘No Secrets’ guidance was replaced by sections 42 to 46 of the Care Act 2014 and this legislation applies to England only.

Information on sections 42 to 46 of the Care Act 2014 can be accessed from chapter 14 of the government’s Care and support statutory guidance (2016): www.gov.uk/guidance/care-and-support-statutory-guidance/safeguarding.

Care providers should review their policies and procedures to ensure that any reference to ‘No Secrets’ is replaced by the above legislation. They should also check that their policies and procedures are consistent with sections 42 to 46 of the Care Act 2014. Failure to do so could result in the service being regarded as one requiring improvement under the safe and well-led key lines of enquiry.
